Child custody is a major concern for anyone contemplating a divorce. And rightly so. Caring for children post-divorce should be of top priority for both spouses. The divorce process is stressful enough, but it’s doubly so when the process is clouded in mystery. Consequently, one way to reduce stress is simply becoming informed, and that includes learning the basics of child custody. There are essentially four types of child custody:

  • Physical Custody
  • Legal Custody
  • Sole Custody
  • Joint Custody

Physical custody means that a parent has the right to have a child live with him or her.

Legal custody of a child means not only having the right but also the obligation to make decisions about the child’s upbringing.

Sole custody defines the situation when one parent has either sole legal custody of a child or sole physical custody.

Joint custody (also called shared custody) defines the situation when the parents are not living together but share decision-making responsibilities for their children and/or also share physical control of their children.
